Lithuania - 2 place (procedures - 3, term - 3.5 days, cost - 0.8% of the value of the real estate object, land administration quality index - 28.5 points);
Georgia - 3rd place (procedures - 1, term - 1 day, cost - 0.0% of the value of the real estate object, index of the quality of land administration - 21.5 points);
Rwanda - 4th place (procedures - 3, duration - 12 days, cost - 0.1% of the value of the real estate object, land administration quality index - 28 points).
In determining the rating of the Republic of Belarus for this indicator, World Bank experts proceed from the assumption that for the acquisition by a private legal entity under a contract of sale of another real estate from another private legal entity (the warehouse building and the land plot on which it is located) in the Republic of Belarus is mandatory Two procedures:
1) obtaining an extract from the registration book to confirm the seller's rights to immovable property;
2) state registration of a transaction of purchase and sale and the rights arising from it for real estate.
It is worth noting that according to the current legislation of the Republic of Belarus, an extract from the registration book is not required to conclude a contract of sale of real estate between legal entities. Belonging to the seller of the rights to the sold object is checked by the registrar at the stage of the state registration of the transaction. At the same time, World Bank experts take into account this procedure due to the fact that in practice legal entities request extracts from the register book in order to avoid temporary and financial losses in case of absence of rights to real estate from the seller.
In the Doing Business 2015 report, a new indicator was introduced for the first time in the context of the property registration index, the land administration quality index. Within the framework of this index, the following are assessed:
The reliability of the infrastructure of the land administration system (responsible for the state registration of immovable property organization, the format of data storage with respect to real estate and cadastral data, the unity of the database with respect to real estate and rights to it). According to this criterion the Republic of Belarus was awarded 7 points out of 8 possible;Additional Information:
Transparency of information (the existence of legally fixed uniform tariffs and time limits for the implementation of procedures, the availability of information on them, the existence of mechanisms to appeal actions in the field of land management and state registration of real estate). By this criterion the Republic of Belarus was awarded 4.5 points out of 6 possible;
Geographical coverage (percentage coverage of the registered land plots of the territory of the Republic of Belarus, percentage coverage of the territory of the Republic of Belarus displayed on the cadastral map). By this criterion, the Republic of Belarus was assigned 4 points out of 8 possible;
The resolution of land disputes (the need for state registration of transactions with real estate, the existence of a mechanism for covering the losses of parties to a real estate transaction registered with violation of legislation, the procedure for identifying parties and verifying the contents of a transaction with real property, and statistics on the consideration of land disputes). By this criterion, the Republic of Belarus was given the maximum possible score - 8;
The index of equal access to real estate rights (introduced in the Doing Business 2017 report, the existence of gender equality in the acquisition and inheritance of immovable property). According to this criterion, the Republic of Belarus was given the maximum possible number of points - 0 (this sub-indicator is assessed on a negative scale of points).
